The ITAT Mumbai held that Slack’s subscription fees were for access to its communication platform, not for the transfer or use of copyright or an underlying process. Accordingly, the receipts were not royalty under the Income-tax Act or the India–Ireland treaty and were not taxable in India absent a permanent establishment.
