The GSTAT held that a Section 129 penalty was unsustainable where the SCN did not specify the alleged statutory contravention, relied-upon statements were not supplied, and the order was passed before the scheduled personal hearing.
The Tribunal also found violations of natural justice and non-application of mind in the appellate order, and consequently set aside the Order in Appeal with consequential relief.
