The Delhi ITAT held that Expedia’s Indian associate performed liaison, administrative, and support functions without authority to negotiate or conclude contracts on behalf of the Swiss entity. Accordingly, no dependent-agent permanent establishment arose under the India–Switzerland DTAA, making profit attribution to an Indian PE academic.
